Terms of Service

These terms govern your use of indiecast. By creating an account or sending email through the service, you agree to them. If you are using indiecast on behalf of an organization, you agree on its behalf.

The service

indiecast lets you store contacts and send newsletters and automated drip sequences to them. We may change, suspend, or discontinue features over time, and we will give reasonable notice of material changes where we can.

Your account

You are responsible for activity under your account and for keeping access to your sign-in email secure. You must provide accurate information and be old enough to form a binding contract in your jurisdiction.

Your contacts and consent

You own the contact data you upload, and you are its data controller. You represent and warrant that, for every contact you email through indiecast, you have a lawful basis and the consent required under applicable law (including CAN-SPAM, GDPR, CASL, and similar regulations). Specifically, you agree that you will:

• Only email people who have agreed to hear from you. No purchased, rented, or scraped lists.
• Accurately identify yourself as the sender and not use false or misleading headers or subject lines.
• Honor unsubscribe requests, which we process automatically and promptly on your behalf.
• Include a valid physical postal address where the law requires one.

Acceptable use

You may not use indiecast to send:

• Spam, or any message to recipients who have not consented.
• Unlawful, fraudulent, deceptive, or infringing content.
• Malware, phishing, or content that harms recipients or the deliverability of the platform.

To protect deliverability for everyone, we monitor bounce and spam-complaint rates and may pause or limit sending (or suspend or terminate accounts) that generate excessive bounces or complaints, send to non-consenting recipients, or otherwise violate these terms.

Intellectual property

indiecast, including its software, source code, design, and branding, is the proprietary property of Sonokinetic and is protected by copyright and other laws. The service is licensed, not sold. Subject to these terms, you get a limited, non-exclusive, non-transferable right to access and use the hosted service for your own business; you get no rights to the underlying source code, and you may not copy, modify, resell, reverse-engineer, or create derivative works of it. You keep ownership of the content and contact data you bring to the service.

Billing

Paid plans are billed through Stripe on a recurring basis until cancelled. Fees are charged in advance and are non-refundable except where required by law. You can cancel at any time; cancellation takes effect at the end of the current billing period. We may change pricing with reasonable advance notice.

Disclaimer and liability

The service is provided "as is" without warranties of any kind. We do not guarantee that every email will be delivered, opened, or free of error. To the maximum extent permitted by law, indiecast will not be liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid us in the three months before the claim arose.

Indemnity

You agree to indemnify indiecast against claims arising from your use of the service, the content you send, or your breach of these terms, including claims by your contacts that you emailed them without consent.

Termination

You may stop using indiecast and close your account at any time. We may suspend or terminate access for breach of these terms. On termination, your right to use the service ends; data handling is described in our Privacy Policy.
